Announment of King Mongkut’s Institute of Technology Ladkrabang on Dress Code Guidelines for Students with Gender Identity or Sexual Orientation Different from Their Sex at Birth, B.E. 2564 (2021)

    King Mongkut’s Institute of Technology Ladkrabang (KMITL) is a higher education institution that recognizes and upholds the rights and freedoms of students in accordance with both national and international human rights principles, particularly in promoting gender equality. The Institute emphasizes non-discrimination and equal treatment of students at all levels, in line with the Gender Equality Act and the Sustainable Development Goals (SDGs).

    It is therefore deemed appropriate to establish guidelines concerning students whose gender identity or sexual orientation does not align with their sex assigned at birth. These guidelines aim to prevent discrimination based on gender identity or sexual orientation and to protect individuals from violations of their dignity, reputation, and human rights. Furthermore, the guidelines aim to safeguard the freedom of expression through speech, behavior, dress, and physical appearance, regardless of a person’s gender identity or sexual orientation. Accordingly, it is appropriate to issue dress code guidelines for students whose gender identity or expression do not correspond to their sex at birth.

    By virtue of Section 34(1) of the King Mongkut’s Institute of Technology Ladkrabang Act, B.E. 2551 (2008), and with the approval of the Executive Board of King Mongkut’s Institute of Technology Ladkrabang at Meeting No. 4–5/2564, held on May 13, 2021, the following announcement is hereby made:

Section 1 This announcement shall be called: “Announcement of King Mongkut’s Institute of Technology Ladkrabang on Dress Code Guidelines for Students with Gender Identity or Sexual Orientation Different from Their Sex at Birth, B.E. 2564 (2021).”

Section 2 This announcement shall take effect from the academic year 2021 onward.

Section 3 Any previous announcements or resolutions that are defined herein or are in conflict with this announcement shall be superseded by this announcement.

Section 4 In this announcement:

“Institute” means King Mongkut’s Institute of Technology Ladkrabang.

“Personnel” means all categories of civil servants and employees of the Institute.

“Student” means a student of King Mongkut’s Institute of Technology Ladkrabang.

“Graduate” means a graduate of the Institute, including holders of bachelor’s, master’s, and doctoral degrees from the Institute.

Section 5 All personnel must treat students whose gender identity or sexual orientation does not align with their sex at birth with respect for their human dignity, rights, freedoms, and gender equality. Acts of bullying, insulting, demeaning, oppression, or harassment toward such students shall be considered disciplinary offenses. This includes employees hired through outsourcing arrangements made via the Institute.

Section 6 Students whose gender identity or sexual orientation does not align with their sex at birth shall have the right to wear the regular student uniform, ceremonial uniform, lab uniform, or faculty/college-specific uniform in accordance with their gender identity. They may do so for attending classes, taking exams, participating in internships, or contacting Institute offices. Attire must be neat, proper, and compliant with the Institute’s regulations on student uniforms.

Section 7 Graduates of the Institute whose gender identity or sexual orientation does not align with their sex at birth shall have the right to wear academic regalia corresponding to their gender identity when participating in the graduation ceremony for the conferment of degrees. Attire must be formal, proper, and in accordance with the Institute’s regulations on academic regalia, academic pins, and regalia for positions.

Section 8 All departments and offices within the Institute are prohibited from issuing announcements, regulations, or guidelines concerning student and graduate dress that result in unfair discrimination against students whose gender identity or sexual orientation does not align with their sex at birth.

Section 9 The President of the Institute shall be responsible for the implementation of this announcement and shall have the authority to interpret and decide upon any matters related to the execution of this announcement.
